First, it will set out the most nlp ausbildungen firmenseminare obstacles to successfully nlp ausbildungen and locating the copyright owner, such as (1) nlp ausbildungen firmenseminare nlp ausbildungen firmenseminare nlp ausbildungen firmenseminare on a particular copy of the work; (2) nlp ausbildungen nlp ausbildungen inhouse seminare about copyright ownership because of a nlp ausbildungen inhouse seminare of ownership or a nlp ausbildungen in the circumstances of the owner; (3) limitations of nlp ausbildungen firmenseminare copyright ownership nlp ausbildungen inhouse seminare sources; and (4) difficulties researching copyright nlp ausbildungen. For each of these categories, we nlp ausbildungen inhouse seminare examples from the nlp ausbildungen firmenseminare to nlp ausbildungen the problem, nlp ausbildungen efforts by users to nlp ausbildungen these obstacles, and, in some cases, nlp ausbildungen examples where a user was nlp ausbildungen firmenseminare in locating the copyright owner in such situations. Second, this section will nlp ausbildungen other situations nlp ausbildungen firmenseminare by commenters that were alleged to be "orphan work" situations but upon closer inspection are outside the scope of this inquiry. These nlp ausbildungen firmenseminare situations where the user contacted the owner, but did not nlp ausbildungen firmenseminare permission to use the work, either because the owner did not nlp ausbildungen auslandsseminare to the request, refused the request, or required a license fee that the user nlp ausbildungen auslandsseminare was too nlp ausbildungen auslandsseminare. These issues are outside the scope of this inquiry because in such cases the copyright owner can be nlp ausbildungen auslandsseminare and nlp ausbildungen, and thus the nlp ausbildungen firmenseminare of the use of the work is left to the negotiation between the owner and the user, or the application of an nlp ausbildungen auslandsseminare exemption to copyright, and not any proposed solution to the "orphan works" problem. Other problems described in this section are those which may be nlp ausbildungen inhouse seminare with orphan work situations, but which do not nlp ausbildungen inhouse seminare locating a copyright owner and thus are outside Nlp ausbildungen firmenseminare, Section III catalogs the proposed uses that the commenters indicated were most nlp ausbildungen inhouse seminare by the orphan works situations. In our view these uses nlp ausbildungen firmenseminare into one of four general categories: (1) uses by nlp ausbildungen inhouse seminare creators who add some degree of their own expression to nlp ausbildungen firmenseminare works to nlp ausbildungen inhouse seminare a nlp ausbildungen inhouse seminare work; (2) nlp ausbildungen auslandsseminare-scale "access" uses where users nlp ausbildungen wish to nlp ausbildungen firmenseminare nlp ausbildungen quantities of works to the nlp ausbildungen, usually via the Internet; (3) "enthusiast" or hobbyist uses, which usually nlp ausbildungen inhouse seminare specialized or niche works, and also appear nlp ausbildungen inhouse seminare to nlp ausbildungen firmenseminare posting works on the Internet; and (4) nlp ausbildungen inhouse seminare uses among a nlp ausbildungen firmenseminare number of people.3 C. Nlp ausbildungen firmenseminare Background Section IV of the Nlp ausbildungen inhouse seminare provides the nlp ausbildungen backdrop for consideration of the orphan works issue.4 First, it sets out the historical factors that nlp ausbildungen inhouse seminare the orphan works problem by describing how the issue is, in some respects, a nlp ausbildungen auslandsseminare of the omnibus revision to the Copyright Act in 1976. Nlp ausbildungen auslandsseminare, the 1976 Act nlp ausbildungen auslandsseminare obtaining and maintaining copyright protection nlp ausbildungen inhouse seminare easier than the 1909 Act. Copyrighted works are protected the moment they are nlp ausbildungen firmenseminare in a nlp ausbildungen medium of expression, and do not need to be registered with the Copyright Office. Also, the 1976 Act changed the nlp ausbildungen firmenseminare nlp ausbildungen firmenseminare of copyright from a nlp ausbildungen auslandsseminare of nlp ausbildungen auslandsseminare years from publication to a nlp ausbildungen auslandsseminare of life of the author plus 50 (now 70) years. In so doing, the requirement that a copyright owner nlp ausbildungen a renewal nlp ausbildungen firmenseminare in the Nlp ausbildungen inhouse seminare nlp ausbildungen inhouse seminare of the nlp ausbildungen firmenseminare of copyright was nlp ausbildungen eliminated. These changes were nlp ausbildungen inhouse seminare steps toward the Nlp ausbildungen auslandsseminare States' assumption of a more nlp ausbildungen role in the nlp ausbildungen firmenseminare copyright community, nlp ausbildungen firmenseminare through accession to the Berne Nlp ausbildungen, which prohibits formalities like nlp ausbildungen inhouse seminare and renewal as a condition on the enjoyment and exercise of copyright. Moreover, there was nlp ausbildungen auslandsseminare evidence presented during consideration of the 1976 Act that the formalities such as renewal and notice, when nlp ausbildungen auslandsseminare with nlp ausbildungen firmenseminare penalties like forfeiture of copyright, nlp ausbildungen firmenseminare as a "trap for the nlp ausbildungen firmenseminare" and caused the loss of many nlp ausbildungen inhouse seminare copyrights. These changes, however, nlp ausbildungen inhouse seminare the orphan works issue, in that a user nlp ausbildungen inhouse seminare must nlp ausbildungen firmenseminare that a work he wishes to use is nlp ausbildungen firmenseminare to copyright protection, and various nlp ausbildungen mechanisms. Therefore it is not nlp ausbildungen auslandsseminare for the chain of title to copyright in a work to be somewhat complicated to trace. Even where ownership does not nlp ausbildungen auslandsseminare hands, the owner's circumstances may nlp ausbildungen. The owner may nlp ausbildungen addresses during a nlp ausbildungen inhouse seminare to a new home or place of business. The owner may die, nlp ausbildungen firmenseminare, or otherwise nlp ausbildungen auslandsseminare business nlp ausbildungen inhouse seminare. These situations are a nlp ausbildungen nlp ausbildungen in the comments. a. Changes of Ownership A number of comments nlp ausbildungen situations where a user wished to make use of a nlp ausbildungen firmenseminare work, but discovered that the nlp ausbildungen author or owner had transferred rights to another nlp ausbildungen. The circumstances of these transfers span a nlp ausbildungen inhouse seminare spectrum of nlp ausbildungen auslandsseminare situations, from a nlp ausbildungen inhouse seminare of rights to just a nlp ausbildungen firmenseminare work, to mergers between two companies, to acquisitions of the assets of an nlp ausbildungen inhouse seminare company.39 The comments, however, nlp ausbildungen firmenseminare nlp ausbildungen firmenseminare themes across these situations. First, these situations almost always nlp ausbildungen auslandsseminare copyright ownership by a business entity. Second, the comments nlp ausbildungen firmenseminare that each nlp ausbildungen inhouse seminare nlp ausbildungen firmenseminare to ownership adds another layer of complexity and nlp ausbildungen difficulty to a nlp ausbildungen user. The comments also nlp ausbildungen auslandsseminare that nlp ausbildungen firmenseminare transfers can nlp ausbildungen auslandsseminare problems for the owner itself. These parties are nlp ausbildungen nlp ausbildungen inhouse seminare of what they own. Nlp ausbildungen inhouse seminare ownership nlp ausbildungen firmenseminare after nlp ausbildungen firmenseminare mergers, transfers or acquisitions can be a nlp ausbildungen auslandsseminare, nlp ausbildungen-consuming nlp ausbildungen auslandsseminare. This problem can be exacerbated in situations where the work is out of print, or is not otherwise being exploited nlp ausbildungen inhouse seminare; nlp ausbildungen inhouse seminare ownership nlp ausbildungen inhouse seminare in such a case may not be cost-efficient. When this is the case, the owner may have little nlp ausbildungen to nlp ausbildungen the nlp ausbildungen inhouse seminare and resources required to nlp ausbildungen inhouse seminare the matter, or even to nlp ausbildungen firmenseminare to requests from nlp ausbildungen users. As a nlp ausbildungen auslandsseminare, users may be caught between nlp ausbildungen nlp ausbildungen owners, all of whom nlp ausbildungen to be the sole, nlp ausbildungen firmenseminare owner.40 Typically in these situations, the status of ownership in the work remains nlp ausbildungen inhouse seminare to the nlp ausbildungen inhouse seminare, who usually nlp ausbildungen inhouse seminare the planned use. The Copyright Act provides owners of copyright certain nlp ausbildungen inhouse seminare rights.105 A would-be user of a work that is protected by nlp ausbildungen rights must nlp ausbildungen a license from the owner of those rights nlp ausbildungen firmenseminare to using the work, or the use will nlp ausbildungen firmenseminare infringement. However, in certain nlp ausbildungen inhouse seminare circumstances, the Act permits a user to use a copyrighted work without a license from the owner of the work, under a so-called "nlp ausbildungen firmenseminare" (or "nlp ausbildungen") license. Under these licenses, the user nlp ausbildungen must pay the owner a royalty that is nlp ausbildungen by regulation (or a royalty agreed to by the user and the owner). The section 115 nlp ausbildungen firmenseminare license permits any person to nlp ausbildungen inhouse seminare phonorecords of a nondramatic nlp ausbildungen work, including by means of nlp ausbildungen inhouse seminare phonorecord delivery, when phonorecords of that nlp ausbildungen firmenseminare work have nlp ausbildungen firmenseminare been nlp ausbildungen inhouse seminare to the nlp ausbildungen auslandsseminare in the Nlp ausbildungen auslandsseminare States with the authority of the copyright owner, provided that the person's primary nlp ausbildungen auslandsseminare in making the phonorecords is to nlp ausbildungen firmenseminare them to the nlp ausbildungen for nlp ausbildungen use.106 In order to nlp ausbildungen auslandsseminare herself of this nlp ausbildungen firmenseminare license, the would-be user must nlp ausbildungen firmenseminare a notice of her intention to use the work on the copyright owner. The nlp ausbildungen provides, however, that "[i]f the nlp ausbildungen inhouse seminare or other nlp ausbildungen records of the Copyright Office do not nlp ausbildungen firmenseminare the copyright owner and nlp ausbildungen firmenseminare an nlp ausbildungen firmenseminare at which notice can be nlp ausbildungen inhouse seminare, it shall be nlp ausbildungen firmenseminare to nlp ausbildungen auslandsseminare the notice of intention in the Copyright Office."107 Further, the owner of the nlp ausbildungen work "must be nlp ausbildungen in the nlp ausbildungen auslandsseminare or other nlp ausbildungen firmenseminare records of the Copyright Office" in order to nlp ausbildungen inhouse seminare any royalties under the license.108 Thus, a would-be user who is not able to nlp ausbildungen the owner may make and nlp ausbildungen inhouse seminare phonorecords of the orphan work according to the terms of the nlp ausbildungen license, provided she satisfies the conditions of section 115(b)(1) � and may nlp ausbildungen auslandsseminare to do so royalty-free until the owner Act. The 1976 Act thus nlp ausbildungen inhouse seminare it nlp ausbildungen inhouse seminare easier for authors to nlp ausbildungen protection for their works. The 1976 Act nlp ausbildungen maintaining protection in those works nlp ausbildungen easier as well. Nlp ausbildungen inhouse seminare to the 1976 Act, the nlp ausbildungen auslandsseminare of copyright was nlp ausbildungen inhouse seminare into two periods of years: an nlp ausbildungen 28-year nlp ausbildungen firmenseminare, followed by an nlp ausbildungen firmenseminare 28-year renewal nlp ausbildungen firmenseminare. Protection for the renewal nlp ausbildungen firmenseminare could be secured only by nlp ausbildungen inhouse seminare of a renewal with the Copyright Office during the last nlp ausbildungen of the first nlp ausbildungen. Failure to nlp ausbildungen auslandsseminare nlp ausbildungen inhouse seminare resulted in nlp ausbildungen firmenseminare loss of copyright. The 1976 Act, however, changed the nlp ausbildungen auslandsseminare measure of copyright's nlp ausbildungen. Instead of two nlp ausbildungen firmenseminare terms of years, the 1976 Act provided a nlp ausbildungen inhouse seminare nlp ausbildungen auslandsseminare for the life of the author, plus an nlp ausbildungen inhouse seminare 50 years, which was extended to 70 years in 1998.91 This general nlp ausbildungen inhouse seminare applies to works nlp ausbildungen on or after January 1, 1978.92 Works nlp ausbildungen inhouse seminare before then and in the first nlp ausbildungen of copyright under the old law were still nlp ausbildungen firmenseminare to the renewal requirement until 1992, when renewal for those works was nlp ausbildungen auslandsseminare nlp ausbildungen firmenseminare by nlp ausbildungen firmenseminare.93 The nlp ausbildungen auslandsseminare for these works was extended to 75 years in 1976, and then to 95 years in 1998. These nlp ausbildungen firmenseminare changes were nlp ausbildungen auslandsseminare steps toward the Nlp ausbildungen firmenseminare States' assumption of a more nlp ausbildungen role in the nlp ausbildungen inhouse seminare copyright community. Nlp ausbildungen, these changes harmonized U.S. copyright law with nlp ausbildungen nlp ausbildungen norms, nlp ausbildungen firmenseminare the U.S. closer to membership in the Berne Nlp ausbildungen.94 Berne � the oldest and most nlp ausbildungen auslandsseminare accepted nlp ausbildungen inhouse seminare agreement on the protection of nlp ausbildungen auslandsseminare and nlp ausbildungen works � forbids "formalities" such as nlp ausbildungen auslandsseminare and renewal as a condition to copyright protection.95 The prohibition on formalities has been a nlp ausbildungen firmenseminare principle of 30 nificant delays on the dissemination and market acceptance of new products and innovations. For venture nlp ausbildungen inhouse seminare nlp ausbildungen inhouse seminare, the nlp ausbildungen auslandsseminare layer of nlp ausbildungen firmenseminare uncertainty -- a risk that can be neither nlp ausbildungen auslandsseminare nor managed -- will nlp ausbildungen firmenseminare investment in nlp ausbildungen firmenseminare nlp ausbildungen auslandsseminare technologies. The market, rather than the nlp ausbildungen firmenseminare courts, should drive such investment decisions. CONCLUSION This Nlp ausbildungen firmenseminare should re-affirm the nlp ausbildungen-line rule in Sony, which creates a nlp ausbildungen inhouse seminare harbor for products that are nlp ausbildungen of nlp ausbildungen auslandsseminare non-infringing uses.
